Winnebago County pretrial release: Illinois no longer uses cash bail
Illinois eliminated cash bail for pretrial release decisions on September 18, 2023. For a new criminal case, the central question is whether the judge orders release with conditions or detention under the Pretrial Fairness Act—not whether a family can raise enough cash to “bond out” the person.
The court considers pretrial release and any conditions at the initial hearing. In qualifying cases, the State may seek detention.
In Winnebago County, a person without private counsel is appointed the Public Defender for the hearing where pretrial release is determined. The appointment may continue if the court later finds the person indigent.
The county’s Pretrial Services Division provides assessments, reports and supervision for people ordered to pretrial supervision.

Where to pick up a released inmate and what happens to money and property
Released inmates are picked up at the Bond Out office. Its entrance is separate from the main Justice Center entrance and is located off West State Street.

The Sheriff explicitly says the time needed to process an inmate for release may vary. Do not assume a court order or release status means the person is already outside.
Commissary money after release
Funds remaining on the inmate account are placed onto a ReleasePay debit card and issued to the inmate at release. ReleasePay customer service is 877-592-1118; the Sheriff lists automated support as 24-hour service and live-agent support from 7 a.m. to 7 p.m. Mountain Time.
Property after release
Property that is not seized as evidence is returned to the inmate at release. The inmate is responsible for checking that property, including medication, has been returned. If law enforcement seized an item as evidence, contact the arresting agency or the State’s Attorney’s Office rather than the jail property window.
What happens when a Winnebago County inmate transfers to IDOC
The Sheriff’s current transfer page says male inmates are first transferred to Stateville Correctional Center until assignment to another state facility.

The Sheriff says remaining commissary and phone funds are transferred to IDOC within seven days of departure, although the inmate may not receive the money until reaching the assigned correctional facility.
Transfer to another county or state
If the inmate is transferred to another county or another state rather than IDOC, the Sheriff’s release page says the funds remain on the Winnebago account until the inmate returns in person or requests transfer. The inmate can write the Trust Fund Officer at Winnebago County Jail, 650 W. State Street, Rockford, IL 61102 and include the receiving facility’s name and address plus the inmate ID assigned by that facility. Funds are not released to another person.
Medical care, mental-health services and PREA reporting
The University of Illinois College of Medicine at Rockford provides around-the-clock medical care in the jail, including medical, dental and pharmaceutical services. The Sheriff’s Operations page also describes behavioral-health assessment and treatment through Freedom Behavioral Health Services and community linkage at discharge.
Medical, dental and pharmaceutical services are available inside the facility; each housing unit has a medical exam room.
